Oftentimes, it is hard to predict an exact course of action or outcome because we are working with other individuals, such as judges, experts, attorneys, and litigants. The first step in an Adoption process is the filing of the Adoption Petition. There are many forms and legal terms involved in this step and having the assurance of a knowledgeable Family Law Attorney filling these out with you is key to your success. One the Adoption Petition has been filed, the Department of Children and Family Services will conduct an investigation into the request. Once this is completed, a Petition for Freedom from Custody is filed in the event of a contested Adoption. The goal of this Petition is to terminate the biological parent’s parental rights. Once this is completed and the report is completed by the Department of Children and Family Services, an Adoption Hearing will be set. That is not the final step and you will need to subsequently submit paperwork to the Department of Social Services to issue a new birth certificate to finalize everything.
