In matters between unmarried parents, the initial step is to file a Petition to Establish Parental Relationship. Once the other party is served, he/she has 30 days to respond to the Petition. If they do not, a Default Judgment may be obtained. In the beginning of the case, if temporary orders are needed, a Request for Order would be filed. The parties will attend Mediation and the Court would make temporary orders. After this step, depending on your specific circumstances, a Trial may be set for permanent orders on Child Custody and Visitation. If the parties agree, a Stipulated Judgment may be entered and this would resolve the case without the necessity of Trial.
